As is known to everyone, the concluded employment contract regulates the relationship between the worker and the employer, and in the event of termination of the employment contract, the worker has the right to suspend the termination of the fixed-term employment contract in the Emirates, and in some cases that we will present to you, the employer has the right to terminate the worker’s contract.

Cases of termination of a fixed-term employment contract in the UAE

In the United Arab Emirates, a fixed-term employment contract can be terminated in any one of the following circumstances:

  • The conclusion of the assigned time frame.
  • To end the agreement, both parties have written consent.
  • if the contract was tied to the personality of the employer, the employer's death would occur.
  • the worker's death or his permanent and utter inability to execute the work for an extended period of time.
  • In accordance with the final verdict, the worker is required to serve a punishment that places restrictions on their freedom for a period of time that is at least three months long.
  • It is being decided to permanently close the facility in compliance with the laws that are now in effect in the Emirates.
  • Insolvency or bankruptcy of the employer is a possibility.
  • For any reason that is beyond the control of the employer, in the event that the worker does not meet the essential conditions to renew the work permit, the worker will be required to pay a fine.

The rights of the worker in a fixed-term employment contract

There are a number of rights that are represented by the worker in a fixed-term employment contract, including the following rights:

  • In the event that the trial term is successfully completed, the right to prolong the contract until the conclusion of the contract period would be granted.
  • The entitlement to receive all monetary obligations, which may include wages and other forms of compensation.
  • If the fixed-term employment contract is about to expire, the employee has the right to request that it be renewed or extended, provided that the employer gives their assent.
  • The right, in the event that the employment contract is terminated, to receive any compensation that is a direct outcome of the employment contract, including end-of-service benefits and vacation money that has been accumulated but not used.
  • The right to request a certificate from the employer that details the date he began working and the date he ended working, the sort of work he was doing, and the most recent wage he was earning at the time of his termination.
  • Article 47 of the United Arab Emirates Labor Law stipulates that he has the right to receive compensation in the event that his employment contract is terminated arbitrarily.
  • The right to retrieve any and all certificates, documents, and tools that were turned over to the employer in order to carry out the duties of the work opportunity.
