What happens after applying for a work permit in Canada?

Abdallah Shahin - | Business

Prior to coming to Canada, it is necessary to submit an application for a work permit. Foreign workers who wish to apply for a visa while located outside of Canada will be required to submit their application to a visa office situated outside of Canada. No additional eligibility criteria are necessary for this process. The visa requirements are contingent upon the specific country or region from which the application is being made. Foreign workers applying from within Canada must also meet specific conditions.

Foreign workers who are applying from within Canada will only be eligible to do so if the following conditions are met:

The user possesses a legitimate study or work permit.

The individual in question is a recipient of a post-graduation work permit from a Canadian university, community college, trade/technical school, or any other suitable educational institution. Additionally, they possess a valid study permit.

Your application for refugee protection has been submitted.

If an individual has been officially acknowledged as a Convention refugee or a protected person by the Immigration and Refugee Board of Canada, they are granted the right to engage in employment within Canada without the requirement of a work permit. However, it is important to note that a work visa is necessary for employment in a different occupation, with the exception of business visitors.

Individuals who are engaged in trading, investing, intra-company transferee activities, or professional activities under the Canada-United States-Mexico Agreement (CUSMA)

Your temporary residence permit is valid for a minimum of six months. You are currently in Canada as you are awaiting and have already submitted an application for permanent residency within the country.

Foreign workers who submit their application upon entering Canada will only be eligible if they meet the following criteria:

Individuals who meet the criteria for an electronic travel authorization (eTA) or travel without a visiting visa should consider whether a visa is required.

Fulfil additional criteria based on the specific category of work permit you are seeking.

It is vital to acknowledge that the duration of your work permit's validity is limited to the duration of your passport's validity. Hence, it is imperative to verify that your passport will be valid for a duration exceeding the mandated extension.

After satisfying the qualifying criteria, individuals must proceed to fill out the application for a work permit and provide the necessary documentation based on their country of origin.

After the submission of the work permit application, the subsequent stage in the procedure involves obtaining approval from the immigration office for the employee. The Canadian Visa Office will initiate contact with the employees. The employer may be requested to participate in an interview or provide documentation by postal mail. The employee may additionally be obligated to undertake a medical evaluation conducted by a designated physician, for which the employee will be responsible for covering the associated expenses. In the event that the employee possesses the requisite qualifications and possesses all the requisite documentation, the application will be granted permission. Subsequently, an approval letter will be provided to the employee for their reference, and the work visa will be issued upon arrival at the port of entry in Canada.

A non-refundable processing charge is required for the acquisition of a work permit. In Canada, it is generally prohibited for visitors to engage in employment activities. Upon securing employment, the visitor will be required to submit an application for a work permit during their stay in Canada. In the event that an individual is a visitor seeking a work permit in Canada and has acquired a valid work permit within the preceding 12-month period, they may seek permission to engage in employment while concurrently submitting their application.

Only individuals who have been granted permission to undertake religious responsibilities are eligible to work in Canada under visitor registries, as long as they explicitly specify in the remarks part of their visitor registry.
