An Emirati court imposes a fine of 10,000 dirhams for hitting a child in the UAE

The Al Ain Court of First Instance ordered a man to compensate a woman 10,000 dirhams for beating her son as natural guardian.

The woman sued the man for 52 thousand dirhams in temporary compensation, compensation for her son for material, moral, and psychological harm, and delayed interest of 12% per year, fees, and expenses. The law firm said he was guilty of abusing her son.

The defense submitted a response memorandum claiming that the lawsuit was dismissed because the plaintiff lacked legal capacity and that the plaintiff was liable for fees, expenses, and attorney fees. The defendant argued that the lawsuit should be dismissed because the plaintiff lacked legal capacity, but the court noted that "what is established from the papers is that the plaintiff filed the lawsuit before the court to demand compensation for her son, for the material, moral, and psychological damages he suffered as a result of the assault committed by Defendant." Therefore, the defendant's defense is unjustified and misguided."

After reviewing the papers and records, the court concluded that the plaintiff relies on the same act as the criminal action.

Convicting the defendant to prove the accusation against him

The criminal ruling in support of the lawsuit found that the defendant was convicted because the accusation against him was proven, determining the occurrence of the act that is the basis for the criminal and civil lawsuits, its legal description, and its perpetrator.

The plaintiff's son suffered physical damage from the defendant's error, as shown by the attached medical report, and the criminal ruling supports the lawsuit and his psychological pain. The error caused the injury, and the defendant must compensate the plaintiff in her capacity. Based on reasons and expenses, the court ordered the defendant to pay the plaintiff 10,000 dirhams and refused all other petitions.

The court found that the defendant's error caused the plaintiff's child's bodily damage, as revealed by the medical report.
