Due to the embezzlement of an amount of 500 thousand UAE dirhams, the Dubai Court decided to imprison a resident of the UAE of an Arab nationality for a period of 6 months, and to fine the amount and deport him from the country after serving the prison sentence.

The accused was convicted of seizing a sum of money worth 500,000 thousand UAE dirhams, and the Dubai Court of Cassation handed the ruling to a special court of appeal.

He was punished with imprisonment for 6 months

The Court of Cassation in Dubai also ruled that the resident of an Arab nationality be punished with imprisonment for a period of 6 months, along with a fine of the amount he embezzled, and his deportation from the country after serving the prison sentence.

Case details

As for the details of the case, the accused was convicted of embezzling funds that were delivered to him in trust, and this matter caused financial damage to the right.

The accused filed an appeal against the ruling issued against him before the Court of Appeal, but the court rejected the appeal on the merits and upheld the initial ruling.

The accused then filed an appeal against the ruling before the Dubai Court of Cassation, which in turn overturned the ruling and returned the case to the Court of Appeal on charges of fraudulently seizing the funds of others for trial before a different body.

Punishment for illegally seizing others’ money in the UAE

It is noteworthy that Law No. (37) of 2009 regarding procedures for recovering public funds and illegally obtained funds in the UAE, which stipulates that if it is proven by a final judicial ruling that the convict (debtor) obtained illegal funds and fails to pay them for any reason However, the execution judge must issue an order, based on the request of the convict (creditor), to imprison the convict for a period of 5 years if the illegal funds required to be paid are not less than 500,000 and not more than 1,000,000 million dirhams.

The penalty shall be imprisonment for a period of 10 years if the illegal funds required to be paid exceed (1,000,000) one million dirhams and up to (5,000,000) five million dirhams. The period of imprisonment shall reach 15 years if the funds exceed 5,000,000 thousand dirhams. 20 years imprisonment if the funds exceed 10,000,000 million UAE dirhams.
