UAE court fines a mother 20,000 AED for aiding her son in beating his friend

A woman and her minor son were found guilty of assaulting another child, resulting in physical injuries. They were subjected to criminal proceedings and fined 10,000 dirhams.

Additionally, the Abu Dhabi Family, Civil, and Administrative Suits Court ruled that the legal guardian of the child (the defendant) and the second defendant were required to compensate the victim's father with 10,000 dirhams for the psychological and material harm inflicted upon his son. Consequently, the total penalty amounted to 20,000 dirhams.

A man, acting as the father of a minor, initiated legal action against his son's friend and the friend's mother, seeking 100,000 dirhams in compensation for the material, moral, and psychological damages suffered by his son. He also demanded that the defendants cover the lawsuit fees, expenses, and attorney's fees, with the ruling mandating expedited enforcement. The court clarified that the defendants assaulted the plaintiff's minor son, leading to criminal convictions and fines of 5,000 dirhams each, along with the obligation to cover judicial fees.

The court elaborated on its ruling, referencing the criminal verdict against the defendants, which established their guilt in committing acts of cruelty that affected the victimized child's psychological well-being by causing physical injuries requiring medical treatment. This incapacitated him from personal work for up to twenty days. The court noted that the same error that led to the defendants' criminal conviction formed the basis for the plaintiff's civil lawsuit, emphasizing the alignment between the criminal and civil proceedings regarding the act's nature and attribution to its perpetrator.

Regarding the compensation claim against the guardian of the minor defendant and the defendant, the court invoked the Civil Transactions Law, which stipulates that every harm caused to another obliges the perpetrator to be liable. The defendants' actions resulted in material and moral damages to the plaintiff's son, including physical assault, psychological distress, and emotional suffering. Consequently, the court deemed it appropriate to award total compensation for all damages incurred by the injured party. The defendants were also ordered to cover fees and expenses, with other requests dismissed.
